YEOUN Terms of Use
This is an English translation of the Korean Terms of Use (Korean original). If the translation and the Korean original differ, the Korean original prevails.
Chapter 1. General provisions
Article 1 (Purpose)
Thank you for using YEOUN. These Terms set out the rights, obligations and responsibilities of Peti Inc. (the “Company”) and users in using YEOUN, the online dating introduction service provided by the Company.
Article 2 (Definitions)
- “User” means a member or non-member who accesses YEOUN and receives the service under these Terms.
- “YEOUN” is the name of this service. Unless stated otherwise, “service” includes all services related to YEOUN.
- “Member” means a person who has verified their eligibility, registered as a member and can use the service.
- “Non-member” means a person who uses the service without registering as a member.
- “Match” means that information about members is disclosed to each other and can be viewed.
- “Connection” means that two matched members have both expressed interest in each other, or that one has requested a chat and the other has accepted.
- “Chat” or “conversation” means that two members who have gone from match to connection can exchange text messages in the service.
- “End of match” or “end of conversation” means that, from a match, connection or conversation, one or both members end the current connection, after which their information is no longer disclosed and cannot be viewed.
- “Bokchae” is a virtual currency in the service. Members spend Bokchae to use certain features of YEOUN.
- Terms not defined above follow the definitions in the relevant laws.
Article 3 (Effect and amendment of the Terms)
- These Terms are posted on the initial screen of the service before sign-up, and take effect for everyone who agrees to them and for all members.
- The Company may amend these Terms where necessary to the extent that this does not violate the relevant laws. As a rule, the Company announces or notifies changes from 7 days before the effective date. If a change is unavoidably unfavorable to you, the Company announces or notifies it from 15 days before the effective date by reasonably available means, such as an email to the address registered in the service or an in-app notification.
- If, despite being clearly told that not objecting by 15 days after the effective date of the amended Terms will be treated as acceptance, you do not express an intention, you are deemed to have accepted the amended Terms. If you do not agree to the amended Terms, you may terminate the agreement at any time.
Article 4 (Rules outside these Terms)
Matters not stated in these Terms are governed by the Framework Act on Electronic Documents and Transactions, the Act on the Consumer Protection in Electronic Commerce, the Act on the Regulation of Terms and Conditions, the Act on Promotion of Information and Communications Network Utilization and Information Protection, and other relevant laws.
Chapter 2. Using the service
Article 5 (The service)
YEOUN is an online dating introduction service and provides the following.
[Service name]
YEOUN (여운)
[Service description]
- Setting up your account and profile based on personality type, dating style, lifestyle or values and the profile you choose to write
- The service's own ideal-match feature, which introduces members to each other based on members' profiles and the match settings of the people they want to be introduced to
- Letting two matched members express interest and chat, or end the match and disconnect at any time
- Editing account information, leaving the service, other app settings, and paying for paid items
- For other questions about the service, use the in-app contact menu and receive an answer within 24 hours.
Article 6 (Termination)
- A member who wishes to terminate the agreement can apply using the account deletion feature in the service.
- When the agreement ends, your information and all data you created are deleted, except where your information is retained under the law and the privacy policy. However, where you were chatting with a connected member, for example, data needed for the other member to keep using the service normally remains in the service and is not deleted.
Article 7 (Restrictions on use)
1. If a member falls under any of the following, the Company may notify the member by email, text message (LMS/SMS) or other valid means and take reasonable measures, such as suspending or restricting use of the service under these Terms until the reason is resolved.
- Part of the personal information registered at sign-up is false, or someone else's personal information was used
- Behaving in a way that makes others uncomfortable in the service
- Interfering with the smooth operation of the service
- Using or distributing programs not permitted by the Company, exploiting bugs, hacking, or otherwise trying to damage the system
- Misuse by a third party caused by a leaked ID or password
- Use of the account has been suspended or restricted under these Terms
- Violating paragraph 3 or the items of paragraph 11 of Article 15 of these Terms
- Continuing conduct under paragraph 3 of this Article after having service use suspended or restricted by the Company two or more times
2. If a member's use is restricted or membership is revoked for violating Article 15 of these Terms, Bokchae and passes cannot be refunded.
3. For users who repeatedly commit illegal acts that are grounds for sanctions under the operating policy in paragraph 1, the Company may revoke membership and restrict re-registration with the same personal details.
4. When the service agreement between a member and the Company ends because the member leaves or membership is revoked, the Company may delete all information related to the account to maintain a better service environment, except where the law requires otherwise. The Company is not responsible for the deletion of account information and content after the agreement ends.
5. Members may object to these measures following the procedure set by the Company.
Article 8 (Payment, refunds and cancellation)
1. Members can use paid services through the payment methods the Company provides. If a payment is processed abnormally and the member asks for it to be corrected, the Company must process the payment correctly.
2. The Company may cancel, or restrict refunds of, amounts charged or paid by fraudulent means or by means the Company prohibits.
3. Bokchae bought or obtained through partners, or obtained through events and other rewards, is in principle not refundable or compensable. Any separately announced refund rules apply.
4. Despite paragraph 7 below, if the paid content you bought differs from what was shown or advertised, or is provided differently from the purchase contract, you may withdraw your purchase within 3 months from the day the content became available, or within 30 days from the day you knew or could have known about it.
5. Members can receive a cancellation, refund or compensation from the Company under paragraph 6 below in the following cases.
- None of the services available through the payment can be used, and the Company is entirely responsible (except unavoidable cases such as announced regular system maintenance)
- A payment is recorded twice because of an error in the systems of the Company or a payment agency
- The Company notifies the member of termination, for example because the service is ending
- Other cases the Company separately sets for consumer protection
- The member requests a refund of a purchased item within 7 days of payment
- When a minor makes a content purchase on a device, the Company informs them that, without a legal representative's consent, the minor or the legal representative can cancel the contract; if a minor made the purchase without the legal representative's consent, the minor or the legal representative can cancel it with the Company. However, it cannot be cancelled if the minor bought the content with property the legal representative allowed them to dispose of within a set scope, or if the minor used deception to make others believe they were an adult or had the legal representative's consent.
- Whether the party to a paid purchase is a minor is judged from the device used for payment, information about the person who made the payment, the holder of the payment method, and similar evidence. To confirm that a cancellation is legitimate, the Company may ask for documents proving the minor and legal representative relationship.
6. The refund and cancellation procedure is as follows.
- Members who want a refund can apply through the in-app contact menu.
- The Company may ask the member to verify their identity if necessary.
- The Company judges whether the reason for the refund request is appropriate, and refunds members who have a reason under paragraph 5 and have followed the proper procedure.
- The Company explains to the member in detail how the refund amount is calculated and the procedure, and then processes the refund or cancellation.
7. Members can get a refund for Bokchae not used within 7 days of purchase. From the 8th day after purchase, a refund is possible only where the Company is recognized to be at fault, for example when items were not delivered because of a system error.
8. If a member is sanctioned, for example suspended or forcibly removed, for violating these Terms, no refund or compensation is given.
9. If the agreement ends because the member leaves voluntarily, items the member holds disappear automatically and cannot be restored or refunded.
10. If, during identity verification, a member's registered information turns out to be false or not to meet the sign-up conditions, the member is disciplined and forcibly removed, and no refund or compensation is given because the member is at fault.
11. Disputes between the Company and users may follow mediation by the Electronic Commerce Mediation Committee established under Article 32 of the Framework Act on Electronic Documents and Transactions.
Article 9 (Use and expiry of Bokchae and items)
1. “Bokchae” is the currency unit used in YEOUN. Members can use their Bokchae for various features in the service.
2. If you delete your account, or your account is deleted because you are at fault, the Bokchae in that account disappears automatically when the account is deleted.
3. If use of your account is restricted because you are at fault, you cannot use Bokchae during the restriction.
4. If there is a problem receiving Bokchae, you can request a correction from the Company within 30 days of the problem, and the Company may adjust it within 30 days of your request.
5. Bokchae is spent starting from the oldest obtained. Remaining Bokchae is calculated the same way for refunds and withdrawals.
6. Bokchae bought by members has no expiry date. Bokchae given in events or for free with a stated expiry date follows that date.
Article 10 (Information and advertising)
1. The Company may show advertising in the service in connection with operating the service. It may also send advertising information by email, text message (LMS/SMS), push notification, KakaoTalk Plus Friend and similar means, only to members who agreed to receive it. Members can refuse at any time, and the Company does not send advertising information to members who refuse.
2. Banners or links in the service may lead to advertising or services provided by others.
3. When you are taken to advertising or services provided by others under paragraph 2, those services are outside the Company's service. The Company does not guarantee their reliability or stability and is not responsible for any resulting damage to members.
4. The Company may send email regardless of the member's consent in the following cases.
- Sending a verification email to confirm ownership of the email address entered when applying
- Sending a verification email to confirm changed member information
- Other information the Company judges to be important for members to know while providing the service
5. The Company is not responsible for problems arising when a member cannot easily receive email, when individual notice is impossible because of restrictions by an email provider, or when a member registered a wrong email address.
6. When a member cannot easily receive email, or when an unspecified number of members must be notified, the Company may post on a notice board in the service instead of individual notice.
Chapter 3. Obligations and responsibilities
Article 11 (Obligations of the Company)
1. The Company does not engage in acts prohibited by law or these Terms or contrary to public morals, and strives to provide a continuous and stable service.
2. The Company maintains security systems to protect personal information (including credit information) so that members can use the service safely, and publishes and complies with its privacy policy.
3. If equipment fails or data is lost or damaged while the Company is improving the service, the Company does its best to repair or restore it without delay, unless there is an unavoidable reason such as a natural disaster, an emergency, or a failure or defect that cannot be resolved with current technology.
4. The Company handles opinions or complaints from users immediately when they are found to be justified. If immediate handling is difficult, it may inform the user of the reason and schedule by phone or email collected with prior consent.
Article 12 (Obligations of members)
1. Members must comply with the relevant laws, these Terms, usage guides and service-related notices, and matters the Company notifies, and must not interfere with the Company's business.
2. When applying for membership or changing member information, members must give true information about themselves based on fact. A member who registers false information or someone else's information cannot claim any rights related to use of the service.
3. Minors (by Korean age) and people who are legally married, in a de facto marriage, or in an equivalent situation cannot use the service.
4. Members cannot transfer or give their right to use the service or their position under the agreement to others, or offer it as collateral or consideration. All rights and responsibilities for posts written by a member belong to that member.
5. Members must not let third parties use their ID and password, and are responsible for all problems arising from poor management or misuse. If a member becomes aware of misuse of their ID, they must notify the Company without delay and follow its guidance.
6. Members must update their information, such as contact details and email address, as soon as it changes. Any damage from delay or wrong information is the member's responsibility.
7. Members may not use the service for commercial activities without the Company's prior approval, and the Company is not responsible for the results of such activities. If the Company suffers damage from such activities, the member must compensate the Company, and the Company may restrict the member's use of the service and claim damages through legal procedures.
8. Members must not collect, copy, distribute or provide information obtained through the service without the Company's express consent, or collect, store or disclose other members' personal information.
9. Members must not impersonate the Company's operators, employees or affiliates, deliberately disrupt the service, or otherwise interfere with its normal operation.
10. Members must comply with these Terms, the other rules and notices the Company sets, and the relevant laws, and must not interfere with the Company's business, damage the Company's reputation, or harm others.
11. In addition, members must not do any of the following.
- Registering false information when applying or changing member information
- Operating two or more accounts
- Acts that violate laws, court judgments, decisions or orders, or legally binding administrative measures
- Acts that harm, or may harm, public order or morals
- Infringing intellectual property rights such as copyrights, trademarks, patents and design rights, or reputation, privacy or other legal or contractual rights of the Company or third parties
- Sending or posting excessively violent expressions, explicit sexual expressions, discriminatory expressions about race, nationality, belief, gender or social status, expressions that encourage suicide, self-harm or drug abuse, or other anti-social content that makes others uncomfortable
- Impersonating the Company or a third party, or deliberately spreading false information
- Sending the same or similar photos, voice or messages to an unspecified number of users, adding other users as friends indiscriminately, or other acts the Company judges to be spam
- Sales, promotion, advertising, solicitation or other commercial acts (except those the Company approves), sexual or obscene acts, requesting or soliciting prostitution, slandering, defaming or insulting other users, or using the service for purposes other than its intended use
- Providing benefits to, sympathizing with or supporting criminal organizations or anti-social forces involved in terrorism, violence, drugs, human trafficking and the like
- Selling or promoting stolen goods, drugs or psychotropic substances, or other products whose import or sale is prohibited in Korea
- Encouraging others to take part in religious activities or join religious organizations
- Disrupting the service's servers and network systems, illegally manipulating the service with bots, cheating tools or other technical means, deliberately exploiting failures of the service, making unreasonable inquiries or demands such as repeating the same complaint more than necessary, or otherwise disrupting the Company's operation of the service or other users' use of it
- Creating data by recording, filming, capturing or photographing while using the service, or leaking such data to third parties or distributing it through third parties
- Aiding or encouraging any of the acts above
12. Members must not create or design false websites online intended to suggest a connection with the Company and/or its assets.
13. Members must not use the Company's assets for commercial purposes, or act in a way that suggests a connection with the Company and/or its assets.
14. Members must not use or access the service by any method or route other than the interface the service provides.
15. Members must not exchange the service's currency or passes for cash, goods or other economic benefits by methods other than those the Company sets.
16. Members must not violate these Terms or the user guidelines.
17. If a member does anything prohibited in Article 15, the Company may take reasonable measures depending on the seriousness of the violation, such as restricting use of the service (suspension or termination of the agreement) or reporting to investigative agencies.
Article 13 (Restrictions and sanctions)
1. The Company may take step-by-step sanctions against a member in the following cases.
- Registering someone else's photo or a celebrity's image as one's own photo
- Registering a generated image (including AI images) disguised as a real photo
- Deceiving others or damaging trust in the service with other false information
- Violating the community guidelines, for example with obscene, violent or hateful expressions
2. Under the Company's internal policy, the following sanctions may be applied step by step for these violations.
- 1st offense: matching suspended for 1 to 2 days
- 2nd offense: matching suspended for 2 to 4 days
- 3rd offense: matching suspended for 4 to 8 days
- 4th offense: matching suspended for 8 to 16 days
- 5th offense or more: suspension of at least 30 days at the operators' discretion, or permanent account suspension
- In particular, if someone else's photo was stolen, civil and criminal legal action may be taken in consultation with the victim
3. When reports from other users accumulate, the Company may review the member's profile, registered images and activity history to investigate a violation, and may act without warning in serious cases.
Chapter 4. Protection of personal information and other matters
Article 14 (Use of personal information)
The Company may collect, with the user's consent, the minimum personal information needed to use the service. Laws on personal information protection apply to it. Your personal information is used only for the purposes and within the scope you agreed to, so that the service can be provided smoothly. Unless required by law or you separately agree, the Company never provides your personal information to third parties. For other details on how the Company collects, protects and handles users' personal information, see the Company's privacy policy.
Article 15 (Protection of users' personal information)
1. In accordance with the Act on Promotion of Information and Communications Network Utilization and Information Protection and other relevant laws, the Company protects personal information recorded when applying for membership, personal information added later, and personal information generated while using the service.
2. The Company's officers and employees must not disclose or distribute members' personal information related to providing the service to third parties other than members of this service. Violating this may be grounds for dismissal.
3. The Company never misuses your privacy and strives to protect members' privacy as required by the relevant laws. Members' personal information is used only for the purposes and within the scope the member agreed to, so that the service can be provided smoothly. For more details, see the service's privacy policy.
4. The Company is not responsible for any information, including account information, exposed because the user is at fault.
Article 16 (Managing and collecting personal information)
1. The personal information members enter at sign-up must be true. Members must also keep updating personal information that changes over time.
2. Members have a duty to keep their profile trustworthy and accurate. Any disadvantage from failing to do so is their own responsibility. If a member enters false or improper information and other members are harmed, all responsibility, including civil and criminal liability, lies with the member who caused the harm, and the Company is not responsible.
3. The Company may request identity verification of the profile information a member entered. Verification is done, for example, by the member submitting identity documents set by the Company, or by going through a reconfirmation and consent procedure for the profile information entered.
4. Depending on the method and procedure, the Company may ask the member for a separate verification fee. The Company does not know whether personal information is accurate between the verification date and the present, and the member is responsible for keeping their personal information current and accurate. Members are responsible for problems arising from this, and the Company is not. The Company may hold the member legally responsible for internal and external losses arising from such problems.
5. The Company recognizes that members hold the copyright in their conversations and protects them from outside access. However, when, at members' request (for example for reports, refunds or compensation), the Company judges that viewing is necessary for service quality and members' safety, it has the right to monitor and take appropriate action. The Company treats members' requests related to chat rooms and their contents as consent to view the chat room, and may monitor without a further consent procedure.
Article 17 (Responsibility for transactions)
1. If the Company suffers any direct or indirect damage (including attorney's fees) arising from your use of the service (including claims the Company receives from third parties because of such use), you must compensate the Company immediately on its request.
2. Members are responsible for their own conduct toward each other. However, if a report is received and the Company judges that the reported member's conduct may cause further harm to other members, the Company may take follow-up measures against those members, such as restricting use, removal, permanent deletion of the ID, or pursuing legal liability, to give members a better service.
Article 18 (Damages)
1. If the Company suffers damage because a member violated these Terms, the member must compensate the Company for the damage. However, the Company bears responsibility for the part for which it is at fault.
2. If, because of a member's illegal acts or violations of these Terms while using the service, the Company receives a claim for damages, a lawsuit or another objection from a third party other than that member, the member must indemnify the Company at their own responsibility and expense. If the Company is not indemnified, the member must compensate the Company for the resulting damage. However, the Company bears responsibility for the part for which it is at fault.
3. The Company is not responsible for any damage related to services provided free of charge, except damage caused by the Company's intent or gross negligence.
Article 19 (Limitation of liability)
1. The Company does not warrant, expressly or implicitly, that the service (including all posts) is free of factual or legal defects (including defects related to safety, reliability, accuracy, completeness, validity, fitness for a particular purpose or security, errors and bugs, and infringement of rights).
2. The Company is not responsible for personal damage arising while accessing or using the service; damage caused by third parties illegally accessing or using the service's servers; damage caused by third parties interfering with transmissions to or from the servers; damage caused by third parties sending or spreading malicious programs; damage from omission, loss or destruction of transmitted data; or damage caused to you by third parties while using the service, such as defamation. To the extent permitted by law, the Company is also not liable for indirect, special, consequential, exemplary or punitive damages.
3. Unless the Company announces that it has separately verified a profile written by a member, it is not responsible for the profile's reliability or accuracy and does not guarantee the member's identity. It is not responsible for mental, material or other damage arising from this.
4. Members are responsible for their own conduct online and offline with other members or third parties. If economic, mental or material damage results, the member who caused it is responsible.
5. The Company will strive to provide you with a stable service. However, it is not responsible at all for any damage you suffer because of the service, including when the service cannot be provided because of natural disasters, war, suspension of service by a common carrier, authentication failures of open IDs provided by third parties, technical defects that are difficult to resolve or other force majeure; neglect in managing passwords; inaccurate personal information; computer errors; problems caused by security issues; network hacking that is difficult to defend against with current security technology; and disputes between members or between members and third parties through the service.
6. If a member does not comply with the relevant laws, these Terms or policies, the Company may investigate the misconduct, stop the member's use of the service, report to investigative agencies, or take other reasonable measures. For other matters about using the service, please contact customer support.
7. Members must use the service at their own responsibility and are fully responsible for everything they do in the service and its results.
8. The service, or communications members receive from it, may contain links to third-party websites or features, and members are responsible for using such links. The Company does not control such third-party content without clear reason. Members must therefore clearly understand that the Company is not responsible in any way for third-party services or features.
9. Members are responsible for all data charges incurred by using the service.
Article 20 (Dispute resolution)
1. If there is a disagreement or dispute between the Company and a member about using the service, both parties must resolve it amicably by agreement.
2. Lawsuits between the Company and members are governed by the laws of the Republic of Korea.
3. Lawsuits about disputes between the Company and members are filed with the court having jurisdiction under the Civil Procedure Act.
Article 21 (Interpretation)
Matters not set out in these Terms and the interpretation of these Terms follow the Act on the Consumer Protection in Electronic Commerce, the Act on the Regulation of Terms and Conditions, other relevant laws, or commercial practice.
